Robert Samartin joined Berman Law Group in February 2021 as a Senior Litigation Attorney. He has over 30 years of experience trying cases in Florida’s courts. Born and raised in Morristown, NJ, he is a graduate of the Nova Southeastern Shepard Broad School of Law. Through the years, Rob has been active with the HCBA, HCACDL, TBTLA, Hillsborough County GAL Pro Bono program, Tampa Chamber of Commerce, The Italian Club, Palma Ceia Little League, and the YMCA Youth Soccer League. He is licensed to practice in the United States District Court for the Middle District of Florida and the United States Court of Appeals – 11 Circuit. He is also a member of the Florida Justice Association as well as the National Association of Criminal Defense Lawyers.

Rob has spent the last 30 years as a trial lawyer exclusively fighting for and safeguarding the rights of individuals and their families, throughout Florida, who have suffered death or traumatic injury as the result of the negligence of others. Throughout his career, Rob has secured numerous six and seven figure verdicts and/or settlements for families whose lives are shattered by reckless individuals or corporations.

Robert specializes in personal injury, auto negligence, nursing home negligence, and product liability. Robert has lived in Florida for 40 years and resides in South Tampa with his wife of 26 years, Julie, and their three sons (all of whom are FSU graduates/attendees).

    Case description: 7-year-old girl suffered traumatic brain injury in a head-on collision
  • Settlement awarded: $1,250,000
    Case description: Wrongful death as a result of a motorcycle crash; case complicated by the comparative negligence of the deceased, who was traveling 30 mph over the speed limit
  • Settlement awarded: $5,000,000
    Case description: Product liability claim against auto manufacturer when two servicemen crashed in highway median and were caught in a truck fire, requiring multiple skin grafting operations for their third degree burns.
  • Settlement awarded: Undisclosed (confidential,significant recovery)
    Case description: Wrongful death of 4-year-old boy with latent heart condition on a thrill ride at a popular hospitality destination. Robert Samartin brought one of the first causes of action in the nation for negligent emergency response due to failure to have readily accessible Automated External Defibrillators (AED) on or around defendant’s rides.
  • Settlement awarded: Undisclosed (confidential, significant recovery)
    Case description: A little more than a year after the above case, Robert tried another case for the wrongful death of a 13 year old boy with a latent heart condition who also exiting a ride. As a result of this litigation, placement of AED’s on or around all thrill rides has become the industry standard.
