If a driver is logged in to the app and is not actively engaged in a trip at the time of the accident both the driver’s personal insurance and Uber or Lyft’s coverage can be utilized. According the Florida statute, rideshare drivers are required to have primary automobile liability coverage of at least $50,000 for death and bodily injury per person, $100,000 for death and bodily injury per incident, and $25,000 for property damage.

If a driver is not logged in to the app or service, their personal insurance will be utilized. Because the driver was not logged in to the app, the $1 million insurance policy from Uber or Lyft will not come into play.
